For decades the big deal trial lawyers were primarily pre-Discovery Act or former criminal practitioners. We’re now seeing a wave of younger civil trial lawyers storming the courtroom doors, refusing offers that undercompensate their clients. Scott’s results read like the introductory speech for a Lifetime Achievement award winner, yet at 39 years old he’s got decades ahead to continue laying defendants low. Over the last two years he’s won a $46 million and a $24.8 million jury verdict for child sex abuse victims. He has already won a CLAY award for the social significance of his results. He’s done this while being a father of a two-year-old with another on the way, and we talk about the tension between parenting and a prodigious practice. Today’s conversation with marketing creative consultant Zach Morvant is a wonderful primer on the marketing details lawyers and law firm professionals should think about but often, in the press of casework, don’t. This Part I of this conversation; tune it next week for Part II. Zach’s background as a creative includes work within large companies like Survey Monkey and Scribd, at the agency level, and running his own creative consulting company. In the brevity and brilliance department he’s the best wordsmith I’ve come across with his ability to pack punchy messaging into very few words. Phoenix grew up in the small southern town of Beebe, Arkansas, where he and his family experienced racist attacks and abuse. These experiences helped fuel Phoenix's drive to become a public defender. He did not take the easy route. Phoenix served our country with four years enlisted in the Navy, then attended UC Berkeley on the G.I. Bill, and finally law school at UC Law. Along the way he’s won every award available to a trial lawyer of his stature, been nominated to every significant invitation-only trial lawyer organization, and has made it a point to give back, mentoring and training the next generation of trial lawyers. Tom and colleague Bob Arns have helmed the University of San Francisco’s trial practice program for the last two decades. We also get the opportunity to discuss life challenges and their impacts. One of Tom’s sons suffered a spinal cord injury and another recently suffering a serious brain injury in a bike crash while Tom was preparing to try a serious brain injury bike crash case. From the 1976 Yuba City bus disaster, where 28 students were killed and 24 critically injured to the more recent Oakland Ghost Ship fire to holding Bank of America accountable for the mistreatment of social security recipients with a $1 billion verdict and all the cases in between, Tom’s been there and done that. One of those was a case Kevin tried with fellow Altair partner Josh White to a stunning verdict in Santa Clara County, a place not known for handing out large verdicts. Kevin is also known for leading the prosecution and trial for one of the higher profile cases in recent Bay Area memory, when an armed individual made it into a UPS facility in San Francisco. The individual used a MAC-10 to kill three and wound two before killing himself. We explore the challenges and logistics involved in working up and trying a complex multi-plaintiff case with 222 – yes that’s 222- depositions. Outside the courtroom Kevin is a talented swimmer and cyclist. He’s leveraged his cycling skill, passion, and knowledge to advocate for fellow cyclists.
